My mobile phone contract with a Maltese provider was supposed to end after two years, but I only found out three months after it silently renewed for another 24 months because I kept getting charged the same monthly fee. I never received a renewal notice. Can I cancel now without penalty?

Telecoms and other ongoing consumer contracts are generally expected to give clear advance notice before auto-renewal, and failing to properly inform a consumer that a fixed-term contract is about to roll over can be treated as an unfair practice under the framework connected to the Consumer Affairs Act, Chapter 378 of the Laws of Malta. Request your account records from the provider showing exactly when and how they claim to have notified you of the renewal, since the burden is on them to show adequate notice was given. If no clear notice was sent, write formally asking to exit the renewed term without an early termination penalty, referencing the lack of proper notification. Should the provider refuse, you can complain to the Malta Competition and Consumer Affairs Authority (MCCAA), and for a formal binding resolution, bring your case to the Consumer Claims Tribunal, which can order the contract terminated or the penalty waived if it finds the renewal process was unfair.
