I bought what was advertised as an authentic designer handbag through an online marketplace, paying through the platform’s checkout, but the item that arrived is clearly a counterfeit. The individual seller is not responding to messages anymore. What can I do, and does the marketplace itself have any responsibility?

Receiving counterfeit goods instead of what was advertised is a clear breach of conformity under the Consumer Affairs Act, Chapter 378 of the Laws of Malta, and depending on how the marketplace platform is structured and what role it played in the transaction, it may also carry some responsibility under consumer protection and platform liability rules. Start by using the marketplace's own buyer protection or dispute resolution process if one exists, since many platforms will refund you directly when a seller goes silent, and gather evidence such as listing screenshots, payment confirmation and photos comparing the item to the genuine product. If the platform's internal process does not resolve things, you can report the seller and the platform's handling of the complaint to the Malta Competition and Consumer Affairs Authority (MCCAA). Selling counterfeit goods is also a separate legal issue that can be reported to the police, and you may still pursue a civil claim through the Consumer Claims Tribunal for a refund.
