Timeshare company in Malta won’t let me exit despite the cooling-off period

Timeshare-type contracts are subject to specific consumer protections that are generally even stricter than ordinary distance or off-premises sales, and Maltese law, aligned with EU rules on timeshare contracts, typically provides a cooling-off period during which any deposit taken must be refundable in full if you exercise your right to withdraw. A blanket statement that deposits are 'non-refundable regardless of timing' is unlikely to be enforceable if it conflicts with your statutory cooling-off right, since consumer protection rules cannot generally be overridden by a contractual clause to your disadvantage. Put your withdrawal in writing immediately, referencing the date you signed and requesting a full refund of the deposit, and keep a copy of everything you were given at the presentation. If the company refuses, report the matter to the Malta Competition and Consumer Affairs Authority (MCCAA), which pays particular attention to timeshare marketing practices, and pursue a refund through the Consumer Claims Tribunal if necessary.
