I ordered a dining table from a shop in Qormi and paid a deposit, with the balance due on delivery. The delivery date has been pushed back three times over three months, each time with a vague excuse. I am starting to think the order was never actually placed. What are my rights?

When a trader fails to deliver goods within the agreed timeframe, or within a reasonable time if no firm date was fixed, the Consumer Affairs Act, Chapter 378 of the Laws of Malta, allows the consumer to set an additional reasonable deadline for delivery in writing, and if that deadline also passes without delivery, you are generally entitled to cancel the contract and demand a full refund of anything already paid, including your deposit. Put this final deadline in writing to the shop, stating clearly that you will treat the contract as terminated and expect your deposit back if the table is not delivered by that date. Keep copies of every previous promised delivery date for evidence of the pattern. If the shop still fails to deliver or refund, you can escalate to the Malta Competition and Consumer Affairs Authority (MCCAA) and, if necessary, file a claim with the Consumer Claims Tribunal to recover your deposit.
