I was scheduled to work on a public holiday in Malta, which I didn’t mind in principle, but I later found out from a colleague that public holiday work is supposed to come with extra compensation, and I was just paid my normal daily rate with no additional amount added. Is my colleague right?

Generally, yes. Under the Employment and Industrial Relations Act, Chapter 452 of the Laws of Malta, and the related regulations on public holidays, an employee required to work on a public holiday is typically entitled to be paid at an enhanced rate for that day, on top of their normal entitlement to the holiday itself, though the exact rate and mechanism can vary depending on the applicable wage regulation order for your specific sector, so the precise premium is worth confirming against the rules that apply to your industry. If you were paid only your standard daily rate for working on the public holiday, with no additional premium at all, this does appear inconsistent with the general entitlement, and you have a reasonable basis to raise the discrepancy with your employer. Request a written explanation of how your public holiday pay was calculated, referencing the specific wage regulation order or contractual provision they relied on. If the explanation doesn't hold up, or your employer simply made an error, you can file a complaint with the Department of Industrial and Employment Relations to have the correct payment enforced.

I had worked at the same company in Malta for almost four years on an indefinite contract when I was called into a meeting and told to leave immediately, no notice, no explanation beyond 'restructuring'. I wasn't accused of any misconduct. Is this actually allowed?

I reported to senior management at my company in Malta that I believed my direct manager was falsifying expense claims, based on documents I had legitimate access to as part of my role. Two weeks later I was suddenly dismissed for what they're calling 'performance issues' that were never raised with me before. I think this is retaliation. What protections do I have?

Is unpaid overtime legal if I’m classified as ‘management’?

I have a manager title at my workplace in Malta, but my day-to-day duties are mostly the same as the staff I supposedly supervise. I regularly work well beyond my contracted hours and my employer says overtime rules don't apply to me because I'm 'management'. Is a job title alone enough to exclude someone from overtime protections?

Do I get compensated for unused annual leave when I resign?

I'm resigning from my job in Malta and I still have about eight days of annual leave that I never got around to using this year. My employer says leave that isn't used before the last working day is simply lost. Is that actually correct, or should I be paid out for it?
