I reported to senior management at my company in Malta that I believed my direct manager was falsifying expense claims, based on documents I had legitimate access to as part of my role. Two weeks later I was suddenly dismissed for what they’re calling ‘performance issues’ that were never raised with me before. I think this is retaliation. What protections do I have?

If your dismissal was genuinely triggered by having made a good-faith report of suspected misconduct, this may fall under whistleblower protections in Malta, which are set out in the Protection of the Whistleblower Act, Chapter 527 of the Laws of Malta, designed specifically to protect employees who report wrongdoing from retaliation such as dismissal, provided the report was made through a qualifying channel and in good faith. The suspicious timing you describe, dismissal shortly after your report and citing vague performance issues that were never previously documented or discussed with you, is exactly the kind of pattern that can support a retaliation claim, especially if your employer cannot produce any prior performance warnings or documentation. Gather everything related to your original report, including dates, who you reported to, and any response you received, along with anything showing your performance was not previously flagged as a concern. You can pursue this both as a whistleblower retaliation matter and as an unfair dismissal claim before the Industrial Tribunal, and it would be worth seeking legal advice promptly given the specific protections and procedures under the Whistleblower Act.

I have a manager title at my workplace in Malta, but my day-to-day duties are mostly the same as the staff I supposedly supervise. I regularly work well beyond my contracted hours and my employer says overtime rules don't apply to me because I'm 'management'. Is a job title alone enough to exclude someone from overtime protections?

I was scheduled to work on a public holiday in Malta, which I didn't mind in principle, but I later found out from a colleague that public holiday work is supposed to come with extra compensation, and I was just paid my normal daily rate with no additional amount added. Is my colleague right?
