Is unpaid overtime legal if I’m classified as ‘management’?

I resigned from my job in Malta after giving the correct notice period, worked through my full notice, and left on good terms as far as I know. It’s now been over two months and I still haven’t received my final salary payment for my last month worked, despite several follow-up messages. What can I actually do to get paid?
Under the Employment and Industrial Relations Act, Chapter 452 of the Laws of Malta, wages owed to an employee, including a final salary payment after termination or resignation, are generally due to be paid by the next scheduled pay day, and an employer failing to pay outstanding wages within a reasonable time after that is in breach of their basic statutory obligations. Send a final written demand to your former employer, clearly stating the amount owed, the period it covers, and a firm deadline for payment, and keep copies of this and your previous follow-up messages as evidence of the ongoing non-payment. If payment is still not made, you can file a formal complaint with the Department of Industrial and Employment Relations, which handles unpaid wage disputes and can help enforce payment, and you also have the option of bringing a claim before the Industrial Tribunal to recover the outstanding amount. Persistent, unexplained non-payment of wages is taken seriously under Maltese employment law, and the delay you have already experienced strengthens rather than weakens your position.
