I secretly recorded a conversation with someone in Malta because I felt I needed evidence of what they were saying to me, without telling them I was recording. Now I’m worried I may have actually broken the law myself by doing this. Is covert recording a criminal offence here?

Whether recording a conversation without the other person's knowledge is itself a criminal offence in Malta depends significantly on the specific circumstances, including where and how the recording took place, and general principles under the Criminal Code, Chapter 9 of the Laws of Malta, alongside data protection obligations under the General Data Protection Regulation (GDPR), which applies in Malta, both come into play, since recording someone without consent can raise both criminal privacy concerns in certain contexts and separate data protection issues regarding the processing of personal data. As a general matter, being a participant in your own conversation and recording it for your own personal, non-commercial purposes, such as keeping a private record, is often treated differently and more leniently than covertly recording or surveilling someone in a place where they have a genuine expectation of privacy without any connection to you, or distributing such a recording to others. Whether the recording could actually be used as evidence in any related proceedings, and whether making it exposed you to any personal legal risk, really depends on the specific facts of how and where it was made, so this is a situation worth discussing directly and promptly with a lawyer rather than assuming either outcome.

I gave a statement to the police in Malta as a witness to an incident, but after thinking about it more, I believe I got a couple of details wrong, not deliberately, just genuine confusion about timing. Can I go back and correct my statement, or am I stuck with what I originally said?

Police came to my apartment in Malta and wanted to search it in connection with an investigation, but they did not show me any written warrant, just said they had 'authority' to enter. Is this legal, and what should I have done in that moment?

I was involved in a physical altercation in Malta after someone attacked me first, and I ended up injuring the other person while defending myself. Now I'm concerned I could face criminal charges myself, even though I genuinely believe I was just protecting myself. How does Maltese law actually treat self-defence?

Is possession of a small amount of cannabis a criminal offence in Malta?

1 answer
I was stopped and found to be carrying what I would describe as a small personal-use quantity of cannabis in Malta. I've heard Malta has changed its laws around cannabis in recent years but I'm not entirely clear on where the actual legal line is now. Am I facing a criminal charge for this?
