Someone has come forward alleging that I committed an offence against them a number of years ago in Malta, something I genuinely don’t recall happening the way they’re describing it. Is there a time limit after which the police can no longer bring charges for old incidents, or can this be pursued no matter how much time has passed?

Maltese criminal law does include prescription periods, essentially time limits, after which criminal proceedings generally cannot be instituted for many offences, and these periods vary depending on the seriousness and specific category of the offence under the Criminal Code, Chapter 9 of the Laws of Malta, with more serious offences generally carrying longer prescription periods, and certain very serious offences, such as some categories of serious violent or sexual offences, in some cases not being subject to standard prescription limits at all. Whether the specific allegation against you actually falls within or outside the applicable prescription period depends entirely on exactly what offence is being alleged and precisely when the events are said to have occurred, both of which need to be properly established before this question can be answered with any confidence in your specific situation. Given that you are facing a serious allegation regardless of its age, it is important to take it seriously and seek legal advice promptly, both to properly assess the prescription question in your specific case and, more broadly, to ensure you are properly advised and represented if the matter proceeds further.

I've been feeling unsafe walking home late at night in Malta and I'm considering carrying a small can of pepper spray for personal protection. I want to make sure I'm not accidentally breaking the law by doing this before I actually buy one.

What happens if someone drops criminal charges against me in Malta?

Someone filed a police report against me in Malta over what I believe was a minor personal dispute, but they've now told me directly they want to withdraw the complaint and don't want to pursue it further. Does that automatically mean the whole matter goes away?

Can my Maltese employer report me to police over a workplace dispute?

I had a serious disagreement with my manager at work in Malta over money I believe I was legitimately owed, and things got heated verbally. My employer is now threatening to report me to the police for 'threatening behaviour', which I think is a wild exaggeration of what actually happened. Can something like this really escalate into a criminal matter?

Do I need a lawyer for a minor traffic offence hearing in Malta?

1 answer
02.07.2026
I've been summoned to the Court of Magistrates in Malta over what feels like a fairly minor traffic offence, and I'm wondering whether it's really necessary to hire a lawyer for something like this, or whether I could just represent myself and explain the situation to the magistrate directly.

Is drink driving in Malta a criminal offence or just a traffic fine?

I was stopped at a police checkpoint in Malta and asked to take a breathalyser test, which came back over the legal limit. The officer mentioned court. I assumed this would just result in a fine like a normal traffic violation, but now I'm worried it's more serious than that. Can you clarify?

Is possession of a small amount of cannabis a criminal offence in Malta?

1 answer
18.08.2026
I was stopped and found to be carrying what I would describe as a small personal-use quantity of cannabis in Malta. I've heard Malta has changed its laws around cannabis in recent years but I'm not entirely clear on where the actual legal line is now. Am I facing a criminal charge for this?

Can a criminal conviction in Malta be appealed, and how long do I have?

1 answer
19.08.2026
I was recently found guilty of an offence by the Court of Magistrates in Malta and I believe the court made a significant error in how it interpreted the evidence against me. I want to appeal but I'm not sure how much time I have or what the actual process looks like.
