My employer in Malta accused me of stealing money from the till and reported it to the police, but that was over four months ago and I’ve heard nothing since, no charges, no further questioning, nothing. Meanwhile I’ve already been dismissed and my reputation feels damaged. What is actually happening in situations like this?

When a report is made to the police, it typically triggers an investigation, and the time this takes can vary significantly depending on the complexity of the case, the evidence available, and current caseloads, with some investigations under the Criminal Code, Chapter 9 of the Laws of Malta, resulting in the matter being shelved due to insufficient evidence without the accused person ever being formally notified that it has been closed, which can leave people in exactly the uncertain position you describe. You are generally entitled to make enquiries about the status of an investigation involving you, and a lawyer can often obtain clearer information than an individual asking directly, including whether the file remains open or has effectively been closed without charges being brought. If no charges have been brought and a reasonable amount of time has passed, it may also be worth having a lawyer formally follow up on the file's status, partly for your own peace of mind and partly because prolonged uncertainty like this can be relevant if you later need to address the reputational and employment consequences you've described, potentially including a separate employment law claim regarding your dismissal.

Can I be charged with two crimes for the same single incident in Malta?

I'm facing what feels like several separate charges arising from a single incident I was involved in Malta, and I don't understand how one event can lead to multiple distinct charges rather than just one. Is this normal, or does it seem like the charges are being unfairly stacked against me?

I was recently found guilty of an offence by the Court of Magistrates in Malta and I believe the court made a significant error in how it interpreted the evidence against me. I want to appeal but I'm not sure how much time I have or what the actual process looks like.

I have an old, relatively minor criminal conviction in Malta from several years ago and it's now creating problems when I apply for certain jobs that require a conduct certificate. Is there any way to have this removed or excluded from future checks?

Do I need a lawyer for a minor traffic offence hearing in Malta?

I've been summoned to the Court of Magistrates in Malta over what feels like a fairly minor traffic offence, and I'm wondering whether it's really necessary to hire a lawyer for something like this, or whether I could just represent myself and explain the situation to the magistrate directly.

What counts as self-defence under Maltese criminal law?

1 answer

I was involved in a physical altercation in Malta after someone attacked me first, and I ended up injuring the other person while defending myself. Now I'm concerned I could face criminal charges myself, even though I genuinely believe I was just protecting myself. How does Maltese law actually treat self-defence?
