I’m in the middle of a dispute with a business partner in Malta over jointly owned property, and I’m genuinely worried he’s about to sell or transfer an asset before the dispute is resolved, which would make it much harder for me to recover what I’m owed. Is there a way to urgently stop this from happening while the underlying case is still ongoing?

Yes, Maltese civil procedure, under the Code of Organisation and Civil Procedure, Chapter 12 of the Laws of Malta, provides for precautionary warrants and interim measures, commonly referred to as garnishee orders, warrants of prohibitory injunction, and similar precautionary acts, which are specifically designed to preserve the status quo or prevent a party from dissipating, transferring, or otherwise dealing with assets in a way that would frustrate the eventual outcome of a pending or imminent legal claim. A warrant of prohibitory injunction, for example, can be used to prevent a specific act, such as the sale or transfer of a particular asset, while the underlying dispute over ownership or entitlement is resolved through the normal court process, but these precautionary measures generally need to be applied for urgently and require you to demonstrate both a genuine, well-founded apprehension that the asset would otherwise be dissipated and a prima facie case on the underlying dispute. Given the urgency you describe and the specific legal thresholds involved in obtaining such precautionary measures, this is a matter that needs immediate attention from a lawyer, ideally the same day, since these applications are specifically designed to be available quickly precisely because delay can defeat their entire purpose.

I'm considering filing a civil claim in Malta over a contractual dispute involving a reasonably significant amount of money, but before committing to litigation, I want a realistic sense of how long court proceedings actually tend to take here, since I've heard mixed things.

During an ongoing arbitration in Malta, I've become concerned that one of the appointed arbitrators has a prior professional relationship with the opposing party that was never disclosed to me. Is there a way to actually challenge or remove an arbitrator mid-process if I believe they may be biased?

I'm in a business disagreement with a former partner in Malta and a mutual acquaintance suggested we try mediation, while my lawyer mentioned arbitration might also be an option under our agreement. I don't fully understand the practical difference between the two processes.
