Can my will in Malta include conditions on how my heirs use their inheritance? 1 answer
1 answerI’m planning my will in Malta and I’d like to attach some conditions to what I leave certain family members, for example requiring a grandchild to reach a certain age or complete their education before receiving their share. Is this actually something Maltese law allows me to do?
What is the disposable portion of an estate in Malta and how is it calculated? 1 answer
1 answerI keep hearing the term ‘disposable portion’ mentioned in relation to Maltese wills and inheritance, alongside the concept of a reserved portion for children and spouses. I don’t fully understand the difference or how the disposable portion is actually calculated in practice.
I’m about to inherit property in Malta from a family member’s estate, and I’m trying to understand what tax implications this actually has. I’ve heard conflicting things about whether Malta even has an inheritance tax as such, or whether the relevant cost is actually something else entirely.
My parent in Malta recently updated their will and, from what I understand, has left me out entirely in favour of a sibling, seemingly due to some personal disagreement between us. I always assumed children couldn’t just be completely disinherited under Maltese law. Is that assumption actually correct?
My parent in Malta recently passed away and I understand I’m entitled to inherit as their child, but I’ve also learned they had some outstanding debts. I’m concerned about whether I could personally become responsible for paying off these debts simply because I’m inheriting from the estate.
What’s the difference between a public will and a secret will in Malta? 1 answer
1 answerI’m planning to make a will in Malta and I’ve come across the terms ‘public will’ and ‘secret will’ as two different options. I don’t fully understand what actually differs between them in practice, or which one might be more suitable for my situation.
I’m planning my estate in Malta and I have a life insurance policy with a named beneficiary. I’m wondering whether I should also mention this policy and its proceeds specifically within my will, or whether the beneficiary designation on the policy itself already takes care of everything independently.
I have a will drafted and executed in my home country, which is outside Malta, but I also own property in Malta. I want to understand whether my existing foreign will would actually be recognised as valid for dealing with my Maltese property, or whether I need a completely separate Maltese will specifically for that.
My relative in Malta co-owned a property together with their sibling, not with a spouse, when they passed away. I’m trying to understand what actually happens to their share of that jointly owned property now, and whether it automatically passes to the surviving co-owner or becomes part of the deceased’s estate to be inherited by their own heirs.
My siblings and I in Malta jointly inherited a property from our parent, but we can’t agree on what to do with it, some of us want to sell, others want to keep it. Is there a legal mechanism to resolve this deadlock, such as forcing a sale, if we genuinely cannot reach agreement among ourselves?
