I signed a konvenju to purchase a property in Malta, but I’ve since had a genuine change of heart and no longer want to proceed with the purchase. I understand this is a binding agreement, but I want to understand what would actually happen if I simply decided not to go through with the final sale.

Since the konvenju is a legally binding preliminary contract under Maltese property law, simply changing your mind without a valid legal basis recognised in the agreement itself generally does not allow you to walk away without consequences, and the specific consequences of failing to complete the purchase as agreed would typically be set out in the konvenju itself, commonly including forfeiture of any deposit you paid at signing, and depending on the specific terms and the seller's response, potentially further liability for damages the seller can demonstrate they suffered as a result of your failure to complete, such as costs from having to re-market the property or a lower price achieved on a subsequent sale. Before assuming you're simply stuck or, alternatively, that you can freely walk away, it would be important to carefully review the specific wording of your konvenju, since some agreements do include specific conditions or exit clauses, such as being conditional upon obtaining financing or a satisfactory survey, and if any such condition genuinely hasn't been met, this could provide a legitimate basis to withdraw without the full consequences of a straightforward breach. Given the potentially significant financial consequences of failing to honour a konvenju, it would be important to consult a lawyer promptly to properly review your specific agreement and advise on your realistic options and likely exposure before deciding how to proceed.
