Can I get my marriage annulled in Malta instead of divorced?

My spouse and I are separating in Malta and we have one child together. I want to understand roughly how child maintenance payments are actually calculated here, since we haven’t been able to agree on a figure ourselves and I want to know what a court might consider reasonable.
Maltese law does not apply a single fixed formula for calculating child maintenance in the way some other jurisdictions do; instead, under the Civil Code, Chapter 16 of the Laws of Malta, the Civil Court (Family Section) generally assesses maintenance based on the child's actual needs, including everyday living costs, education, healthcare, and other reasonable expenses, weighed against the financial means and earning capacity of both parents, aiming to ensure the child's standard of living is reasonably maintained and that the financial burden is shared fairly between both parents relative to their respective resources. Because there is no single fixed formula, the amount can genuinely vary quite significantly between cases depending on both the specific needs of your child and both parents' actual financial circumstances, meaning a reasonable maintenance figure for your family cannot really be estimated without a proper review of both your and your spouse's income, expenses, and your child's specific needs. Given that maintenance disputes are heavily fact-dependent, it would be worth working with a family lawyer to prepare a clear breakdown of your child's actual needs and both parents' financial circumstances, which can then either support a negotiated agreement or, if necessary, be presented to the court for a formal determination.
